ELITE CUSTOMER CARE PROGRAM RULES
AVAILABLE IN THE US ONLY
Important:
The
following provisions form the basis of the Sargent-Welch Elite Customer Care
Rewards Program which was initiated on January 5, 2004. These provisions are
intended to protect you, the members of the program, and Sargent-Welch. The
following provisions will govern your participation in this program and it is
your responsibility to read and understand all of them. For more information,
contact Sargent-Welch Customer Service Department or your local sales
representative. These Program Rules cannot be superseded or changed, except in
writing from Sargent-Welch.
General Conditions
1. Membership in the Elite Customer Care Rewards program and the benefits that
it offers are provided at the discretion of Sargent-Welch. Sargent-Welch has
the right to terminate the Program or to change the Program Rules,
regulations, benefits, conditions of participation or reward levels, in whole
or in part, at any time, with or without notice, even though changes may
affect the value of reward points already accumulated. Sargent-Welch may,
among other things, withdraw, limit, modify or cancel any award; increase the
number of points necessary to earn a particular award. Members, in
accumulating reward points, may not rely upon the continued availability of an
award or award level, and members may not be able to redeem all of their award
points.
2. Participation in the Elite
Customer Care Rewards program is subject to any terms and conditions, rules,
regulations, policies, and procedures that Sargent-Welch may, at its discretion,
adopt from time to time. Sargent-Welch has the sole right to interpret and apply
the Program Rules. Any failure to follow Program Rules, abuse of Program
privileges, conduct detrimental to the interests of Sargent-Welch, or any
misrepresentation of any information furnished to Sargent-Welch by any member,
or anyone else acting on the member's behalf, may result in the termination of
his or her membership, the cancellation of accrued points, or both.
3. Each member shall be
responsible for remaining knowledgeable as to the Program Rules and the amount
of points in his or her account. Sargent-Welch shall attempt to advise active
members of various matters of interest through such means as may be appropriate,
such as account summaries, newsletters and its Web site, but Sargent-Welch shall
have no liability for any failure to do so. Sargent-Welch will not be
responsible for correspondence lost or delayed in the mail. Each member shall be
responsible for advising Sargent-Welch of any change of address, and
Sargent-Welch shall have no liability for misdirected mail or any consequences
thereof.
4. The accumulation of award
points are subject to specific Program Rules enacted by Sargent-Welch. Each
member is responsible for reading those materials in order to understand his or
her rights and responsibilities under the Program. No points earned or granted
under the program may be transferred or assigned except as expressly permitted
by Sargent-Welch in writing.
5. Membership in the Elite
Customer Care Rewards Program is open to individual legal residents, schools,
and school districts of the continental United States, Alaska and Hawaii (not
valid in Puerto Rico), except employees (and their immediate families and
members of the same household) of Sponsors, their respective affiliates, agents,
judges and advertising and promotion agencies. This Program is void outside the
United States, where prohibited or restricted by law or school policy and
subject to all applicable federal, state and local laws and regulations".
With that being said, each member name may only appear in only one account. For
example if a district enrolls all science teachers in the program in order to
consolidate award points, a teacher in the district can’t also receive points
to an individual account. Duplicate accounts will be subject to cancellation.
Only the member named on the account will be entitled access to personal account
information.
6. Accrued points do not
constitute property of the member. Neither accrued points nor certificates are
transferable (i) upon death, (ii) as part of a domestic relations matter, or
(iii) otherwise by operation of law.
Sale of reward points
7. The sale or barter of any such points, awards or benefits other than by
Sargent-Welch is expressly prohibited. Any points transferred, assigned or sold
in violation of the Program Rules, in addition to exposing the member to the
penalties otherwise associated with violations, may be confiscated or cancelled.
The use of awards that have been acquired by purchase, barter, or other conduct
in violation of Program Rules may result in, at Sargent-Welch’s discretion, a
request being made for repayment in an amount equal to the value of the items
illegally acquired.
Account activity
8. Any member who fails to earn points during the first twelve months after
enrollment in the Program may be removed from the Program.
9. Any member who fails at any
time to engage in account activity for a period of thirty-six (36) consecutive
months is subject to termination of his or her membership and forfeiture of all
accrued points.
10. "Account activity",
for purposes of these Rules, shall be deemed to occur when a member accrues
points in his or her account in any manner set forth in these Rules, or as
otherwise approved by Sargent-Welch, or when the member redeems any award points
using the on-line rewards catalog.
Accrual of Reward of Points
11. Only members of the Sargent-Welch
Elite Customer Care program are eligible to accrue reward points in this
program. Currently, points can be accrued by purchasing products listed in the
Sargent-Welch Catalog, Sargent-Welch promotional materials, or those on the
Sargent-Welch website, by using a credit card, check, or purchase order made out
to Sargent-Welch. At the time of order, program member must indicate his/her
program membership number. Your membership number must be clearly legible and
accurately depicted if written on a purchase order, entered on the Sargent-Welch
website, or given verbally over the phone. Failure to indicate the
membership number will result in points not being accrued.
Merchandise that is returned will cause accrued points associated with
merchandise also to be forfeited. Award points will not be accrued for credits
and/or complimentary merchandise. "Award points in two or more different
accounts may not be combined to redeem any award". Sargent-Welch expressly
reserves the right to establish additional means of accruing reward points, to
delete any or all of the means currently recognized, or to exclude specific
types of transactions.
12. If Sargent-Welch improperly
denies a member an accrual or benefit, liability will be limited to the
equivalent of that accrual or benefit".
13. The award structure is subject
to modification, cancellation or limitation at Sargent-Welch’s discretion,
with or without notice. The amount of reward points required to redeem any award
may be substantially increased, any award may be withdrawn, and restrictions on
any award or its redemption may be imposed at any time. The accumulation of
award points does not entitle program members to any vested rights with respect
to any awards or the program.
14. The Sponsor of this Program is

Restrictions on membership
15. Participation in the Elite Customer Care Rewards Program may be prohibited
or restricted by some states, districts or schools. Nothing in these Rules
should be read to override or circumvent any such laws or policies. Foreign
membership is not allowed under the rules of this program.
